UPDATE June 19, 2024 : The Final Approval Hearing occurred on June 12, 2024. At the hearing, Judge Michael O’Foghludha heard from the parties and granted the motion for Final Approval of the Class Action Settlement; granted Plaintiffs’ Motion for Attorneys’ Fees and Expenses and Class Representative Service Awards; and entered Final Judgment. The Final Approval Order and Judgment will be final 30 days from June 13 (the “Final Approval Date”). PRA will have 30 days from the Final Approval Date to pay $5.75 million into a Settlement fund set up by the Settlement Administrator. Afterward, the Settlement Administrator will distribute Settlement Checks to class members as soon as possible, with payments expected to be mailed out after August 12, 2024.

A North Carolina Court has taken the first step in approving the Settlement of a class action lawsuit described below. The Action involves certain debt collection activity in North Carolina by Portfolio Recovery Associates, LLC at any time after October 1, 2009, through September 30, 2023.
The case is named Pounds v. Portfolio Recovery Associates, LLC, and is CASE NO. 16-CVS-5190, pending in the Superior Court of Durham County, in Durham, North Carolina (the “Action”). The judge in charge of the case is North Carolina Superior Court Judge Michael O’Foghludha.

If you object to the Settlement, you will remain a Class Member, but you may not file a request for exclusion (i.e., opt-out) from the Settlement.
